General Terms
By accessing and placing an order with AR Drawing, you confirm that you are in agreement with and bound by the terms of service outlined below. These terms apply to the entire AR Drawing platform and any communication between you and AR Drawing, including but not limited to emails, customer support, and other interactions.
Under no circumstances shall AR Drawing or its team be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data or profits, arising out of the use, or the inability to use, the materials or services provided by AR Drawing, even if the team or an authorized representative has been advised of the possibility of such damages. If your use of materials or services from this platform results in the need for servicing, repair, or correction of equipment or data, you assume any associated costs.
AR Drawing will not be held responsible for any outcomes that may arise during the use of our services. We reserve the right to change prices and revise the resources usage policy at any time, and any changes will be communicated accordingly.
License
AR Drawing grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use our service strictly in accordance with the terms of this Agreement.
These Terms & Conditions constitute a binding contract between you and AR Drawing (referred to in these Terms & Conditions as “AR Drawing,” “us,” “we,” or “our”), the provider of the AR Drawing app and the services accessible from the app or website (collectively referred to as the “AR Drawing Service”).
By using the AR Drawing Service, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not use the Service. In these Terms & Conditions, “you” refers both to you as an individual and to the entity you represent. If you violate any of these Terms & Conditions, AR Drawing reserves the right to cancel your account or block access to the app without prior notice.
Definitions and Key Terms
- Cookie: A small amount of data generated by the app and saved by your web browser. It is used to identify your browser, provide analytics, and remember information about you such as your language preference or login information.
- Company: When this policy mentions “Company,” “we,” “us,” or “our,” it refers to AR Drawing, located in Bangladesh, which is responsible for your information under these Terms & Conditions.
- Country: The country where AR Drawing or the owners/founders are based, in this case, is Bangladesh.
- Customer: Refers to any person or entity that uses the AR Drawing app to create, manage, or share artistic content.
- Device: Any internet-connected device such as a phone, tablet, computer, or any other device that can be used to visit AR Drawing and use the services.
- IP address: Every device connected to the internet is assigned an IP address. This number can often be used to identify the location of the device.
- Personnel: Refers to individuals employed by AR Drawing or under contract to perform a service on behalf of the company.
- Personal Data: Any information that can be used to identify an individual, directly or indirectly, including names, email addresses, and IP addresses.
- Service: Refers to the service provided by AR Drawing, including the AR drawing features, video recording, and sketching tools available through the app.
- Third-party service: Refers to advertisers, contest sponsors, marketing partners, or other third-party providers of content or services within the app.
- You: A person or entity who uses the AR Drawing app and services.
Intellectual Property
The platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof), are owned by AR Drawing, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. The material may not be copied, modified, reproduced, downloaded, or distributed in any way, in whole or in part, without express prior written permission, except as expressly provided in these Terms & Conditions. Unauthorized use of the material is prohibited.
User-Generated Content
By using the AR Drawing app, you may upload, submit, or share content such as drawings, sketches, images, videos, and other materials (“User-Generated Content”). You retain all ownership rights to your User-Generated Content, but by submitting or sharing it through the AR Drawing platform, you grant AR Drawing a worldwide, royalty-free, non-exclusive license to use, display, modify, and distribute your content in connection with providing and improving the service, including promotional purposes.
You are solely responsible for the User-Generated Content you upload, and by submitting such content, you represent and warrant that:
- You own or have the necessary rights to the content you upload.
- Your content does not infringe the intellectual property rights of any third party.
- Your content complies with all applicable laws, including copyright and privacy regulations.
AR Drawing reserves the right to review, moderate, and remove any User-Generated Content that it deems to be unlawful, offensive, or violating our Terms & Conditions. We also have the right to suspend or terminate your account if you repeatedly violate these terms or submit inappropriate content.
You agree not to use the AR Drawing app for any unlawful purpose or to engage in any activity that could harm the app, other users, or the overall experience.
This license granted to AR Drawing remains in effect as long as the User-Generated Content remains on the platform. You can remove your content at any time by deleting it from the app, but any content previously shared may still exist in archived or cached copies and may remain visible in certain portions of the app.
Prohibited Activities
When using the AR Drawing app, you agree not to engage in any of the following prohibited activities:
- Illegal Activities: Using the app for any unlawful purpose or to promote illegal actions, including, but not limited to, violating copyright, trademark, or other intellectual property rights, or engaging in activities that violate local, state, national, or international laws.
- Infringing Intellectual Property Rights: Uploading, posting, or sharing content that infringes on the intellectual property rights (e.g., copyrights, trademarks, patents) of others without permission.
- Harassment or Abuse: Engaging in any form of harassment, abuse, or threatening behavior toward other users or individuals, including but not limited to bullying, defamation, or hate speech.
- Malicious Content: Uploading or distributing viruses, malware, spyware, or other harmful or malicious software that could damage, disable, or impair the functionality of the AR Drawing app, the devices of other users, or any connected systems.
- Impersonation: Impersonating another person or entity, including, but not limited to, using someone else’s username, email address, or other identifying information, or creating misleading or fraudulent accounts.
- Spamming or Advertising: Using the app to send unsolicited advertisements, promotional materials, or other forms of spam, or attempting to collect personal data or contact information from other users for such purposes.
- Circumventing Security: Attempting to bypass or disable security measures, or engaging in activities designed to manipulate or interfere with the operation of the AR Drawing app, including data mining, scraping, or reverse engineering.
- Exploiting Vulnerabilities: Attempting to exploit any technical vulnerabilities in the AR Drawing app to gain unauthorized access to the platform, user accounts, or any other system.
- Disrupting Service: Interfering with the normal operation of the app or disrupting access to the service for other users, including attempts to overload or crash the app’s infrastructure or servers.
- Misuse of User-Generated Content: Posting or distributing content that is offensive, harmful, misleading, or violates the rights of others, including content that contains hate speech, pornography, or explicit materials.
AR Drawing reserves the right to take appropriate action, including suspending or terminating your account, if you engage in any of the above activities. These actions may also include reporting violations to relevant authorities, where appropriate.
By agreeing to use the AR Drawing app, you acknowledge that these rules are designed to maintain a safe and respectful environment for all users. Violating any of these prohibited activities may result in immediate consequences, including the removal of content, account suspension, or legal action, as necessary.
Advertising
The App serves ads through Google Ad Mob. By using the App, you agree to receive advertisements. You acknowledge that the ads served may be based on your usage data and interests. More information on how Google Ad Mob handles your data can be found in our Privacy Policy.
In-App Purchases
The App may offer in-app purchases for additional features or content. Any in-app purchases are final and non-refundable, except as required by applicable law or under specific terms provided by the platform from which the purchase was made (e.g., Google Play Store).
Term and Termination
This Agreement shall remain in effect until terminated by you or us. We may, at any time, suspend or terminate this Agreement with or without notice, at our sole discretion. Termination of this Agreement will be immediate in the event that you fail to comply with any provision of this Agreement. You may terminate this Agreement by deleting the app and all copies of it from your device. Upon termination, you must cease all use of the service and remove all copies of the service from your devices. Termination will not limit any of our rights or remedies at law or in equity if you breach any obligations under this Agreement.
Entire Agreement
These Terms & Conditions, along with our Privacy Policy, constitute the entire agreement between you and AR Drawing regarding the use of our services. Any previous agreements, communications, or representations regarding the subject matter of these Terms & Conditions are superseded by this Agreement.
Submissions and Privacy
Any content, feedback, or suggestions you submit to AR Drawing through the app or related services will be treated as non-confidential and non-proprietary. By submitting such content, you grant AR Drawing a perpetual, irrevocable, royalty-free license to use, modify, and distribute the content.
Disclaimer
The AR Drawing app and its services are provided “as is,” without any warranties of any kind, either express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, secure, or error-free. AR Drawing will not be responsible for any damages arising from the use or inability to use the service.
Limitation of Liability
To the maximum extent permitted by applicable law, AR Drawing and its developers will not be liable for any indirect, incidental, or consequential damages arising from your use of the App. This includes but is not limited to loss of data, loss of profits, or interruptions in service.
The App is provided “as is,” and we make no warranties, express or implied, about the App’s functionality, reliability, or availability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.
Changes to These Terms
We may modify these Terms at any time. If changes are made, we will notify users via the App or by other means. Continued use of the App after changes to the Terms constitutes acceptance of the updated Terms.
